Terms and Conditions

These Terms and Conditions (“Terms”) form a legally binding agreement between you and [LEGAL ENTITY NAME], doing business as MotorScored (“MotorScored,” “we,” “us,” or “our”), concerning your access to and use of motorscored.com and related services, content, and features collectively referred to as the “Service.”

By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement to independently create an account, purchase a subscription, represent an organization, or enter a sponsorship arrangement.

A competitor between 13 and the age of legal majority may use the Service only with the permission and supervision of a parent or legal guardian. The parent or guardian is responsible for the minor’s account and activity.

The Service is not available to children under 13.

If you use the Service for a company or organization, you represent that you have authority to bind that organization to these Terms.

2. The MotorScored Service

MotorScored provides tools through which:

  • Competitors can create profiles, display racing information, connect with sponsors and coordinators, participate in events, and manage sponsorship activity.
  • Sponsor companies and representatives can discover competitors and events, communicate with users, and manage sponsorship relationships.
  • Event coordinators can publish events and results and communicate with competitors and sponsors.
  • Users can message, connect, publish content, submit reviews, and view statistics, rankings, and MotorScore information.

We may add, modify, suspend, or discontinue features. We do not guarantee that any particular feature will remain available.

3. Accounts

You agree to:

  • Provide accurate, current, and complete information.
  • Maintain only accounts you are authorized to control.
  • Keep your credentials confidential.
  • Promptly update information that changes.
  • Notify us immediately of unauthorized access.
  • Accept responsibility for activity performed through your account.

You may not impersonate another person, misrepresent an affiliation, create accounts using another person’s information without authorization, or transfer an account without our written permission.

4. Account Types and Organizational Authority

Sponsor representatives must be authorized to act for the sponsor company they identify. Event coordinators must be authorized to publish or manage the events they identify.

MotorScored may request verification of identity, company authority, event authority, racing information, sponsorship history, or account eligibility. Verification does not constitute an endorsement or guarantee.

5. User Content

“User Content” includes profiles, photographs, logos, videos, messages, reviews, event details, results, sponsorship information, comments, and other material submitted through the Service.

You retain ownership of your User Content. You grant MotorScored a worldwide, nonexclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, format, display, distribute, and otherwise use your User Content as reasonably necessary to operate, secure, improve, and promote the Service.

For private messages, this license is limited to operating, securing, and enforcing the Service.

You represent that:

  • You own or have permission to submit the User Content.
  • The content is accurate where presented as factual.
  • Its use does not violate privacy, publicity, intellectual-property, contractual, or other rights.
  • You have appropriate consent before posting information or images of another person, including a minor.

You may remove certain content through the Service. Copies may remain in backups, legal records, event histories, reviews, results, or content shared with other users.

6. Reviews, Scores, Rankings, and Statistics

Reviews must reflect genuine experiences and may not be false, misleading, retaliatory, manipulated, or submitted in exchange for undisclosed compensation.

MotorScore points, rankings, ratings, statistics, and recommendations may be calculated from user-submitted information, event data, sponsorship records, social activity, reviews, or automated rules.

They are informational tools only. They are not credit ratings, financial advice, guarantees, certifications, or endorsements. We do not guarantee their accuracy, completeness, availability, or suitability for a particular decision.

You may not manipulate rankings, create false engagement, fabricate results, coordinate fraudulent reviews, or interfere with scoring systems.

7. Sponsorships and User Transactions

MotorScored provides tools for users to discover and communicate with each other. Unless expressly stated otherwise, MotorScored:

  • Is not a party to sponsorship agreements between users.
  • Is not an agent, broker, fiduciary, insurer, employer, or legal representative of any user.
  • Does not guarantee sponsorships, payments, performance, attendance, results, exposure, or return on investment.
  • Does not independently verify every representation made by users.

Users are responsible for conducting appropriate due diligence and entering separate written agreements addressing compensation, deliverables, intellectual-property rights, exclusivity, disclosures, cancellation, insurance, taxes, and liability.

Users must comply with advertising and endorsement-disclosure laws when posting or promoting sponsored content.

8. Events and Motorsport Risks

Event coordinators are responsible for the accuracy of event information and for obtaining applicable permissions, insurance, sanctions, licenses, safety personnel, and regulatory approvals.

MotorScored does not control third-party tracks, events, organizers, vehicles, participants, or safety procedures. Event listings do not constitute an endorsement or guarantee.

Motorsport activities are inherently hazardous and may cause property damage, serious injury, or death. You are responsible for evaluating risks, following event and track rules, using suitable safety equipment, and obtaining appropriate insurance.

Nothing on the Service replaces professional safety, legal, medical, mechanical, or insurance advice.

9. Acceptable Use

You may not:

  • Violate applicable law or another person’s rights.
  • Harass, threaten, stalk, discriminate against, or exploit another person.
  • Publish illegal, defamatory, fraudulent, deceptive, or infringing content.
  • Send spam, unauthorized advertising, or repeated unwanted messages.
  • Upload malware or interfere with Service security or operation.
  • Scrape, harvest, or collect user information without authorization.
  • Attempt to bypass access controls or gain unauthorized access.
  • Reverse engineer the Service except where law expressly permits it.
  • Use automated systems to manipulate traffic, rankings, points, or engagement.
  • Submit fabricated racing, event, sponsorship, payment, or performance information.
  • Use another user’s personal information outside the purpose for which it was provided.
  • Use the Service to facilitate unsafe, illegal, or fraudulent conduct.

We may investigate and take appropriate action, including content removal, feature restrictions, account suspension, or termination.

10. Subscriptions, Billing, and Renewals

Some features require a paid subscription. Prices, billing periods, included features, and applicable taxes will be disclosed at purchase.

If checkout identifies a subscription as automatically renewing, you authorize us and our payment provider to charge the selected payment method at each renewal until canceled.

You may cancel through [ACCOUNT CANCELLATION METHOD]. Unless stated otherwise at purchase, cancellation takes effect at the end of the current paid term.

Fees are nonrefundable except where required by law or expressly provided in our [REFUND POLICY LINK].

We may change future subscription pricing after providing legally required notice. A price change will not apply retroactively to a completed billing period.

Failure to pay may result in suspension or downgrade of paid features.

11. Electronic Communications

You consent to receive electronic communications relating to your account, transactions, security, subscriptions, sponsorship activity, and use of the Service.

You may opt out of promotional emails, but not essential transactional, security, or legal communications.

12. Intellectual Property

The Service, excluding User Content, including its software, design, branding, logos, text, scoring systems, databases, and other materials, is owned by MotorScored or its licensors and is protected by applicable law.

These Terms grant you a limited, revocable, nonexclusive, nontransferable right to use the Service for its intended purpose. No other rights are granted.

“MotorScored,” its logo, and related branding may not be used without written permission.

13. Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice to [COPYRIGHT EMAIL] containing:

  • Identification of the copyrighted work.
  • Identification and location of the allegedly infringing content.
  • Your contact information.
  • A statement of good-faith belief that the use is unauthorized.
  • A statement, under penalty of perjury, that the notice is accurate and you are authorized to act.
  • Your physical or electronic signature.

If applicable, designate and register a DMCA agent before relying on United States DMCA safe-harbor procedures.

14. Third-Party Services

The Service may contain links or integrations operated by third parties. We do not control and are not responsible for third-party content, products, policies, availability, or conduct.

Your dealings with third parties are between you and those parties.

15. Suspension and Termination

You may stop using the Service at any time and may request account deletion subject to our Privacy Policy.

We may restrict, suspend, or terminate access if we reasonably believe you:

  • Violated these Terms.
  • Created legal, security, or safety risks.
  • Engaged in fraudulent or abusive activity.
  • Failed to pay required fees.
  • Exposed MotorScored or another user to liability.

Where appropriate, we may provide notice and an opportunity to appeal. We may preserve information as required for legal, safety, fraud-prevention, or legitimate business purposes.

16. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

MOTORScored DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • USER INFORMATION OR CONTENT WILL BE ACCURATE.
  • ANY USER WILL RECEIVE A SPONSORSHIP, INVITATION, PAYMENT, RANKING, OR BUSINESS RESULT.
  • EVENTS, VEHICLES, USERS, SPONSORS, OR COORDINATORS ARE SAFE, QUALIFIED, INSURED, OR RELIABLE.
  • DEFECTS OR DATA LOSS WILL ALWAYS BE PREVENTED OR CORRECTED.

Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOTORScored AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OPPORTUNITIES, SPONSORSHIPS, OR GOODWILL.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID MOTORScored DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  • US $100.

These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MotorScored and its owners, officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, and reasonable legal expenses arising from:

  • Your User Content.
  • Your use or misuse of the Service.
  • Your violation of these Terms or applicable law.
  • Your sponsorships, events, transactions, or dealings with another user.
  • Your infringement or violation of another person’s rights.

This section does not require indemnification for MotorScored’s own unlawful conduct where such indemnification is prohibited.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles.

Subject to applicable consumer law, disputes shall be brought exclusively in the state or federal courts located in [COUNTY, STATE], and each party consents to their jurisdiction.

Before filing a claim, each party agrees to provide written notice and attempt in good faith to resolve the dispute informally for at least 30 days.

Nothing prevents either party from seeking appropriate relief in small-claims court or emergency injunctive relief where available.

20. Changes to These Terms

We may update these Terms periodically. We will post the revised Terms and update the “Last Updated” date.

If a change materially affects your rights, we will provide additional notice where required. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.

21. General Provisions

These Terms and the Privacy Policy constitute the entire agreement concerning the Service unless a separate written agreement applies.

If a provision is found unenforceable, it will be modified only as necessary, and the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our permission. We may assign them in connection with a merger, reorganization, financing, or transfer of the Service.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limitations, indemnification, and dispute provisions.
